Open Burning in Ohio

Open Burning in Ohio is illegal without a burn permit.

 

  • It is illegal to burn within 50 feet from any structure.

  • You must obtain a burn permit prior to burning in Burton Township, or Claridon Township.

  • It is illegal to burn within the Village limits, unless it is a  recreational fire (cooking of hotdogs, marshmallows, etc.).

  • It is illegal to burn any hazardous waste.

 

Requirements for Burning

  1. Only seasoned non-treated hardwood may be burned, and  shall  not exceed 3 inches in diameter.

  2. Height of woodpile shall not exceed 3 feet.  Diameter of wood pile shall not exceed 5 feet, unless prior authorization is given.

  3. Fire watch to stand guard until fire and all coals are totally extinguished.

  4. Applicant shall provide either a charged garden hose or portable  fire extinguisher large enough to extinguish the fire.

  5. Excessively high winds may result in revocation of permit.

  6. At least 1 person 18 years of age or older shall be present at all times.

  7. All burns will be during daylight hours only.

  8. Person present during authorized burning will have access to a working phone on site and call 9-1-1 if open burn becomes uncontrollable at any time.

  9. Failure to abide by any state, federal or local laws regarding open burn, shall be subject to penalties.

  10. ALL PERMITS ISSUED SHALL BE VOID, IF AN OZONE ACTION DAY IS DECLARED.

 

  • Residents are asked to please stop by  the Burton Fire Department for a free burn permit, prior to burning.
